Early Morning Collision in San Leandro Leaves Driver Injured

Anderson Franco Law

In the early hours of December 8, 2024, a traffic collision occurred on southbound State Route 13 at the Lincoln Avenue offramp in San Leandro. At approximately 3:39 AM, a maroon Honda CR-V collided with a telephone pole, blocking the offramp lane. Emergency services were promptly dispatched to the scene.

The driver of the vehicle was found inside, bleeding from injuries sustained in the crash. Fire and medical units arrived shortly after the incident was reported, providing necessary medical attention to the injured driver. The vehicle suffered major front-end damage and was later towed from the scene by San Leandro Tow.

Authorities have cleared the scene, but motorists are advised to exercise caution when traveling through the area. The cause of the collision remains under investigation. Our thoughts are with the injured driver, and we hope for a swift recovery.

Potential Legal Considerations

When someone is hurt because another person was careless, it is called negligence. In these cases, the person who got hurt might have the right to get help or money for what happened. To show that someone was negligent, you need to prove four things: duty, breach, causation, and damages. First, the person who caused the harm must have had a duty to be careful. Second, they must have failed to be careful, which is called a breach. Third, this breach must have directly caused the harm. Finally, there must be actual harm or damages.

Victims of negligence can often file a claim to get compensation for their injuries. This means they might get money to help pay for things like medical bills or other costs related to the incident. Sometimes, the person who caused the harm has insurance that can help cover these costs. For example, if the incident involved a car accident, the driver’s car insurance might pay for the damages. It’s important for victims to report the incident to the insurance company as soon as possible to start the claims process.

Insurance claims can be complicated, and it’s important for victims to understand their rights. They should keep records of everything related to the incident, like medical visits and any communication with the insurance company. This information can help support their claim. If the insurance company does not offer enough money to cover the damages, the victim might need to talk to a lawyer to see if they should take further legal action. A lawyer can help explain the victim’s rights and what steps to take next.
