Hit-and-Run Incident on I-280 in San Jose Leaves Multiple Injured

Anderson Franco Law

A hit-and-run collision involving three vehicles occurred on the southbound lanes of Interstate 280 near the US 101 interchange in San Jose on Monday, October 14, 2024, at approximately 1:17 PM. The incident involved a black Toyota sedan and an unidentified gray vehicle, with one vehicle reportedly leaving the scene. At least one of the vehicles ended up in a ditch on the right-hand side of the highway.

Emergency services were promptly dispatched to the scene, where they found the black Toyota with front-end damage and blocking the slow lane. Fire and medical personnel attended to the injured, although the exact number of casualties remains unclear. The California Highway Patrol (CHP) closed the incident at 2:07 PM, and City Tow was called to remove the damaged Toyota from the scene.

Motorists are advised to exercise caution when traveling through the area as cleanup and investigation efforts continue. Authorities are urging anyone with information about the vehicle that fled the scene to come forward. Our thoughts are with those affected by this unfortunate event, and we hope for a swift recovery for the injured.

Potential Legal Considerations

When someone is hurt because another person was careless, it’s called negligence. In a situation like a car accident, if a driver doesn’t follow the rules of the road and someone gets hurt, the driver might be responsible for those injuries. The person who got hurt, called the victim, has the right to ask for help to cover things like medical bills and other costs that come from the accident. This is important because it helps the victim get back to normal life as much as possible.

In a hit-and-run accident, where a driver leaves the scene, it can be more complicated. The victim still has rights, but finding the person responsible can be harder. If the driver is found, they can be held accountable for their actions. The victim can then make a claim against the driver’s insurance to help pay for the costs related to the accident. If the driver isn’t found, the victim might need to use their own insurance, if they have coverage for uninsured or underinsured drivers.

Insurance plays a big role in these situations. Most drivers have insurance that can help pay for damages and injuries. If the victim has insurance, they should contact their insurance company as soon as possible to report the accident. The insurance company can help guide them through the process of making a claim. It’s important for victims to keep records of everything related to the accident, like medical visits and repair bills, to support their claim.

Overall, the legal system and insurance are there to help victims of accidents. They provide a way for victims to get the support they need to recover. It’s important for victims to know their rights and to take action quickly to make sure they get the help they deserve.
