Anderson Franco Law

A significant traffic collision involving four vehicles occurred on southbound Interstate 280 near the Bascom Avenue offramp in San Jose on December 14, 2024, at approximately 2:31 PM. The incident involved a silver Acura MDX, a black Ford Escape, a silver Toyota Yaris, and another unidentified vehicle. The collision blocked lanes 3 through 5, causing substantial traffic delays in the area.

Emergency services, including the California Highway Patrol and fire department, responded promptly to the scene. Tow trucks from local companies were dispatched to clear the vehicles, and all units were reported clear by 3:58 PM. Fortunately, the collision resulted in minor injuries, as indicated by the 1181 code, which refers to a traffic collision with minor injuries.

Motorists are advised to exercise caution and consider alternative routes to avoid congestion in the affected area. Our thoughts are with those involved in the accident, and we hope for their swift recovery. As always, drivers are reminded to maintain safe distances and adhere to speed limits to prevent such incidents.

Potential Legal Considerations

When someone is hurt because another person was careless, it’s called negligence. In these cases, the person who got hurt might have the right to get help or money for what happened. To show that someone was negligent, you need to prove a few things. First, you have to show that the person who caused the harm had a duty to be careful. Then, you need to prove that they didn’t act carefully, and because of that, someone got hurt. Finally, you have to show that the harm wouldn’t have happened if the person had been careful.

If someone is hurt because of negligence, they might be able to make a claim with the insurance company of the person who was careless. This is called an insurance claim. The insurance company might pay for things like medical bills or other costs related to the harm. It’s important for the person who got hurt to keep track of all their expenses and any other problems they have because of the incident. This information can help when talking to the insurance company.

Sometimes, the insurance company might not want to pay what the person thinks they deserve. If this happens, the person who got hurt might need to talk to a lawyer. A lawyer can help explain the person’s rights and might be able to help them get a fair amount of money. It’s important for people to know that they have rights and that they can ask for help if they need it.
