Fatal Pedestrian Accident on I-680 in San Jose Causes Traffic Disruptions

Anderson Franco Law

A tragic accident occurred on the evening of November 26, 2024, on Interstate 680 South near Berryessa Road in San Jose, resulting in the death of a pedestrian. The incident took place at approximately 8:33 PM when a pedestrian was struck by a vehicle in the southbound lanes. Emergency services were promptly dispatched to the scene, but the pedestrian succumbed to their injuries.

The accident led to significant traffic disruptions as all lanes were initially blocked, prompting authorities to issue a SigAlert. Efforts were made to divert traffic and clear the scene, with one lane eventually reopened to alleviate congestion. The involved vehicle, a white Ford pickup truck, sustained major front-end damage and was parked on the right-hand side of the highway.

Our thoughts are with the victim’s family and loved ones during this difficult time. Motorists are advised to exercise caution and remain vigilant for pedestrians, especially in areas with limited visibility. The highway has since been fully reopened, and traffic flow has returned to normal.

Potential Legal Considerations

When someone is hurt because another person was careless, it is called negligence. In these cases, the person who got hurt might have the right to get help or money for what happened. To prove negligence, the injured person must show that the other person had a duty to be careful, did not act carefully, and that this caused the injury. For example, if a driver does not pay attention and causes an accident, they might be responsible for the harm caused.

Victims of such incidents can seek compensation for their injuries. This compensation can cover things like medical bills, lost wages from not being able to work, and other costs related to the incident. Sometimes, the person who caused the harm might have insurance that can help pay for these costs. This is why it’s important for victims to report the incident and gather evidence, like photos or witness statements, to support their claims.

Insurance claims play a big role in personal injury cases. If the person who caused the injury has insurance, the victim can file a claim with that insurance company. The insurance company will then investigate the claim and decide how much money to offer the victim. It’s important for victims to know that they can negotiate with the insurance company to try to get a fair amount that covers all their expenses.

In some cases, if the insurance company does not offer enough money, the victim might need to go to court to get what they deserve. A lawyer can help with this process by explaining the victim’s rights and helping to gather the necessary evidence. Overall, understanding negligence and how insurance claims work can help victims get the support they need after an injury.
