Hit-and-Run Incident on US101 in San Jose Leaves Victims Injured

Anderson Franco Law

A hit-and-run incident occurred early Friday morning on the northbound US101 at the Alum Rock Avenue offramp in San Jose, leaving several individuals injured. The incident was reported at approximately 12:12 AM on February 21, 2025. Emergency services were promptly dispatched to the scene, where they found a white 2013 BMW 528i sedan with significant rear-end damage.

Authorities have confirmed that the driver responsible for the collision fled the scene, prompting a search by the San Jose Police Department. Despite efforts to locate the suspect vehicle, no matches have been found as of yet. The victims involved in the crash received immediate medical attention, and their current conditions remain undisclosed.

In light of this incident, motorists are advised to exercise caution when traveling through the area. The California Highway Patrol has issued a notice that there will be no Freeway Service Patrol (FSP) on US101 from Ellis Street to Monterey Road until further notice. Our thoughts are with the victims and their families during this difficult time, and we urge anyone with information about the incident to contact local authorities.

Potential Legal Considerations

When someone is hurt because of another person’s carelessness, it is called negligence. In these cases, the person who got hurt might have the right to ask for money to help with their recovery. This is called a personal injury claim. To prove negligence, the injured person must show that the other person had a duty to be careful, did not act carefully, and that this caused the injury. For example, if someone is driving a car, they have a duty to follow traffic rules and drive safely. If they don’t, and someone gets hurt, they might be responsible for the injury.

Victims of negligence can often make claims against the person who caused the harm. This can include asking for money to cover medical bills, lost wages, and other costs related to the injury. Sometimes, the person who caused the injury has insurance that can help pay for these costs. For example, if the injury happened in a car accident, the driver’s car insurance might cover the damages. It’s important for victims to gather evidence, like photos and witness statements, to support their claim.

Insurance claims can be a big part of personal injury cases. If the person who caused the injury has insurance, the victim can file a claim with the insurance company. The insurance company will then investigate the claim to decide how much money to offer. Sometimes, the insurance company might not offer enough money to cover all the costs. In these cases, the victim might need to negotiate or even go to court to get fair compensation. It’s important for victims to understand their rights and to seek help if they need it.
