Pedestrian Accident on Story Road in San Jose Leaves Two Injured

Anderson Franco Law

In the early hours of September 21, 2024, a traffic collision involving a vehicle and two pedestrians occurred on Story Road near the southbound on-ramp to US-101 in San Jose. The incident was reported at approximately 1:45 AM, with emergency services arriving on the scene shortly thereafter. Initial reports indicate that two female pedestrians were struck by a vehicle, resulting in significant injuries and bleeding.

Emergency responders, including fire and medical personnel, were dispatched immediately and arrived at the scene by 2:00 AM. The injured pedestrians were found blocking the roadway and were promptly attended to by the first responders. Both victims were transported to a nearby hospital for further medical treatment. The condition of the pedestrians remains unknown at this time.

The collision caused temporary road closures and traffic disruptions on southbound US-101 near Story Road as authorities worked to clear the scene and investigate the circumstances surrounding the accident. Motorists were advised to seek alternative routes to avoid delays. The San Jose Police Department is conducting a thorough investigation to determine the cause of the accident and whether any charges will be filed.

Our thoughts are with the victims and their families during this difficult time. Authorities urge drivers to exercise caution, especially during late-night hours, to prevent such tragic incidents.

Legal Analysis: In this incident, the pedestrians who were struck by the vehicle may have grounds for a personal injury claim against the driver. Personal injury law allows victims to seek compensation for medical expenses, lost wages, pain and suffering, and other damages resulting from the accident. To establish negligence, the victims would need to prove that the driver failed to exercise reasonable care, leading to the collision.

The driver’s insurance policy will likely be the primary source of compensation for the victims. If the driver is found to be at fault, their liability insurance should cover the medical expenses and other damages incurred by the pedestrians. It is important for the victims to document their injuries and medical treatments thoroughly to support their claims.

Additionally, if the driver was found to be under the influence of alcohol or drugs, or if they were driving recklessly, this could strengthen the victims’ case for negligence. Legal representation can help the victims navigate the complexities of personal injury law and ensure they receive fair compensation for their suffering and losses.
