Traffic Collision in San Jose Causes Fuel Leak, No Injuries Reported

Anderson Franco Law

A traffic collision involving a 26-foot yellow truck and a smaller white truck occurred on McKean Road in San Jose at approximately 2:14 PM on March 24, 2025. The incident resulted in the larger truck tilting on its side, partially blocking both the southbound and northbound lanes. Fortunately, no injuries have been reported.

Emergency services, including the fire department and California Highway Patrol, responded promptly to the scene. The fire department identified a fuel leak from the overturned truck, which was carrying a load of trees. The leaking fuel posed a potential environmental hazard as it was seeping into a nearby drain. As a precaution, authorities temporarily shut down McKean Road at Bailey to manage the situation and prevent further risks.

A heavy-duty tow truck was requested to safely remove the vehicles involved. Motorists are advised to avoid the area and seek alternative routes while cleanup and recovery efforts are underway. The incident serves as a reminder of the importance of road safety and the potential dangers of transporting heavy loads. Our thoughts are with those affected by this incident, and we commend the swift response of the emergency services in mitigating the situation.

Potential Legal Considerations

When someone is hurt because another person was careless, it’s called negligence. In these cases, the person who got hurt might have the right to get help or money to make up for what happened. To show that someone was negligent, the injured person needs to prove a few things. First, they must show that the other person had a duty to be careful. Then, they need to prove that the person did not act carefully and that this caused the injury. Finally, they must show that they were actually hurt because of this carelessness.

If someone is hurt because of negligence, they might be able to file a claim with the other person’s insurance company. This is because many people have insurance to help pay for accidents they cause. The insurance company might pay for things like medical bills or other costs related to the injury. However, sometimes insurance companies do not want to pay, or they might not pay enough. In these cases, the injured person might need to talk to a lawyer to help them get what they deserve.

It’s important for victims to know their rights and understand that they can seek help. They should keep records of everything related to the accident, like doctor visits and any costs they have because of the injury. This information can be very helpful if they need to make an insurance claim or go to court. By knowing their rights and taking the right steps, victims can work towards getting the support they need to recover.
